SUBJECT: Noise Ordinance Amendments – Construction Noise

The Town Council has asked the Planning Board to revisit discussions about the noise ordinance amendment dealing with construction-related noise. The current noise ordinance exempts construction noise between the hours of 7 AM to 9 PM everyday. There is no restriction in addition to these hours for Sundays or holidays. At the September meeting the Town Council considered the draft ordinance forwarded from last month’s Planning Board which proposed limiting construction noise on Sunday and holidays to hours between 1 PM and 9 PM.
The Council specifically requested that the Board review noise ordinances from other resort communities, and consider language that would allow construction noise on Sundays and holidays between 1 PM and 9 PM to homeowners only. Another option would be to eliminate construction noise on Sundays and holidays as some resort communities have done. I have enclosed some ordinances and information from other communities
I have also enclosed a copy of the draft noise ordinance amendment sent to Council in September.
